“Senior White House adviser David Plouffe said Sunday that the White House is ‘confident’ its health care overhaul will be upheld as constitutional by the Supreme Court — and that, ultimately, Republicans are going to regret having branded it ‘Obamacare,’ ” Lucy Madison reported Sunday for CBS News.

“The Supreme Court will hear arguments this week over the Obama administration’s landmark Affordable Care Act, which celebrated its two-year anniversary last week.”

Plouffe made his comments on “Fox News Sunday,” whose host, Chris Wallace, was one of two Sunday talk-show hosts to use the “Obamacare” term to describe the health-care reform plan. The other was George Stephanopoulos of ABC’s “This Week.” Hosts on NBC, CBS, C-SPAN and CNN left that characterization to their Republican guests. Stephanopoulos did not respond to a request for comment.

    Do not count your hatch until it is chickens.

    There is one level at which I hope the Supremes allow it. We have to make the choice as stark as we can, and that would do it, I think. They can do anything they want to, unless we stop them. And now would be a very good time.

  • I’m thinking that it will be close with Anthony Kennedy being the deciding vote. I also think we won’t find out the opinion until mid summer or early fall, but we’ll know before the election.

    The decision will come late enough in the election cycle to afford it to the Rethugs! to rally the base with, along with the notion of SCOTUS openings 2012-2016, and keep dems from using it in the same fashion.

    As Jefferson101 notes we shouldn’t start counting chickens and such, but it sure looks bad based on the lines of questioning, and the interrogatory exchanges. Which, I need to comb the transcript but it appears that Justices Sotamayor and Kagan didn’t take part much…

    Still, one can’t help anticipate a schadenfreudalicious outcome, with the associated rending of garments and gnashing of teeth; augmented by wailing over “the most conservative court in 50 years”, the justices on the take, and the conflict of interest of Justice Thomas-vice the absolute moral certitude and authority of Elena Kagan.
